Yes, you can sometimes build over or near a Sydney Water sewer. But there is no blanket approval and no single setback that applies to every site. What you can build depends on the sewer, its exact location and condition, the proposed structure, excavation, foundations, easements and Sydney Water’s need for future access.
The key question is whether the development can be designed so the sewer remains protected, accessible and serviceable. That should be established before the building footprint, basement and structural system are fixed.
What does Sydney Water allow?
Sydney Water’s current technical guidelines allow some structures to be built over or adjacent to certain sewer assets when specified conditions are met. The rules are not the same for every pipe. A 2025 guideline update expanded some in-scope building-over scenarios for gravity sewerage pipelines up to DN750, but that does not mean every sewer of that size can automatically be built over.
Some assets are specifically excluded from standard build-over arrangements. These include pressure water and wastewater pipes, wastewater property connection points and maintenance structures, pipes larger than DN750, easements, assets in poor condition and asbestos cement pipes. Site conditions can also affect the assessment.
If the proposed work could affect an asset, Sydney Water may require further assessment through a Water Servicing Coordinator. A site-specific review is therefore more useful than relying on a general rule.
How close can you build to a Sydney Water sewer?
There is no universal clearance distance. The required separation depends on the type and diameter of the pipe, its depth, the location of footings or piles, excavation limits, building loads and the space required for maintenance or future replacement.
A basement, retaining wall, swimming pool or deep footing can affect a sewer even when the structure does not sit directly over it. Sydney Water also treats maintenance structures differently from the pipe itself. Maintenance holes, shafts, chambers and similar access points must remain accessible for inspection and repair.
A setback used on another development should not be assumed to apply to your property.
Confirm the sewer before finalising the design
The first task is to establish what asset is on the site and where it actually sits. A service location diagram can show that a Sydney Water pipe is present, but Sydney Water notes that it does not pinpoint the exact physical location.
Where accurate location is important, a Service Protection Report may be required to identify and peg the asset on site. The project team can then compare that information with the survey, building footprint, basement excavation and foundation layout.
If there is a potential conflict, the Sydney Water building plan approval process can identify what additional information or protection measures are required. For projects needing closer technical review, a Water Servicing Coordinator in Sydney can assess the plans, coordinate asset information and manage the approval pathway.
What happens if the building conflicts with the sewer?
A conflict does not automatically mean the development cannot proceed. The design may, however, need to change.
Depending on the asset and proposed works, the response may involve adjusting the building footprint, modifying foundations, using piering to transfer structural loads away from the pipe, increasing clearance or carrying out an approved asset-protection measure. Sydney Water may also require investigation of the pipe’s condition before accepting a structure above or close to it.
For more significant conflicts, adjustment or relocation of the sewer may need to be considered. This can add design, approval and construction requirements, so it is better identified before architectural and structural drawings are substantially complete.
Concrete encasement, piering and relocation are possible responses in appropriate cases. They are not standard solutions for every sewer conflict.
Why early review matters
Treat the sewer as a design constraint from the beginning, not an approval issue to solve at the end. Early input from civil engineering consultants in Sydney can help determine whether the footprint, levels, excavation and foundations are compatible with the asset.

A sewer crossing the property does not necessarily prevent development. What matters is the type of asset, its verified location, how the proposed works affect it and what Sydney Water requires for approval.
